Patent Trial and Appeal Board
In the USPTO, the Patent Trial and Appeal Board (PTAB) is an internal appeals board. Before the America Invents Act, it's name was Board of Patent Appeals and Interferences (BPAI).
Decisions
- Bilski: The BPAI rejected the Bilski patent. This decision was upheld by the CAFC in the 2008 in re Bilski case. As of April 2010, the US Supreme Court is reviewing the CAFC's decision in the case Bilski v. Kappos.
- In re Alappat (1994, USA): Here the USPTO rejected the patent, the BPAI overturned the rejection, and the CAFC reinstated the rejection.
