Statistics, categorising, and counting patents
A few methods have been devised to categorise masses of patents as being software patents or not. These methods can be used for the purposes of counting the number of software patents in a patent office's database.

A mistake to avoid: when looking at who the victims of software patents are, counting litigation will give a very skewed result because it misses the big problem of passive threats.
